China sees its urbanization speeding up and the urban size continuously expanding. The construction of new districts and the rebuilding of the old all need a legal and sound detailed urban planning as the point of departure. However, because of defects of our country's urban planning system and the limits of administrative procedure law, the detailed urban planning, which underlies urban reconstruction, fails to acquire a legal status. As a result, citizens cannot obtain timely and effective protection by following the administrative proceedings if their rights and interests were violated.
