对底层劳动者立法保护不够是目前国劳动领域出现的主要问题。针对这一问题，目前存在两种看法，即“劳资冲突说”和“劳动者分层保护说”。这两种学说在调整对象、调整方法、调整原则上均存在较大差异。前者认为，资方和劳方之间存在整体性的阶级冲突,具体表现在权利和地位方面；后者认为，不宜将劳动者简单化为一个阶层，而应分为四个阶层。其中，各个阶层之间的利益有同有异。相应地，保护策略也应视其各自的特点而定。

英语语境:

The lack of legal protection constitutes as one of the severe problems in the labor sphere. There are two views diverging on this issue. One of them is based on the dichotomy of labourer and capitalist. It points to the direct class conflict within the dichotomy. The other view holds that the dichotomy is stuck in the mire of oversimplification. Within the class of labour itself, there could be further defined four types of labour dwelling upon different layers of classification. The legislation, therefore, should take the traits and needs of different labours into consideration.

英语语境:

The theory of class broadly refers to all the theories of class and class struggle. In the narrow sense, it refers specifically to the Marxist theory of class and class struggle. Scholars before or of Marx's times have already discussed those facts of class and class struggle. However, they failed to reaching the full understanding that class division was a historical phenomenon, and thus didn't see the economic roots of the formation of class and the essence of class struggle.
