清除与ＷＴＯ规则相冲突的有关法律，制定并完善与ＷＴＯ规则相适应的法律，是目前我国立法的重要任务之一。我国刑法在对商标的保护对象、关于假冒注册商标罪的行为范围以及关于其它商标犯罪的规定等方面均有待完善。应该扩大假冒注册商标罪的行为范围、增设反向假冒商标罪并将假冒注册服务商标行为明文规定为犯罪。
