随着城市化进程的不断深入,城市建设用地需求量增大,政府征收农村土地也越来越多。但由于我国土地征收法律制度的自身缺陷,由征地引发的失地农民问题日益严重。要想改变现状,政府应尽快转变其在土地征收过程中的角色,严格界定“公共利益”的范围。公益性用地领域实行政府征购农村土地,非公益性用地领域开放农村土地交易市场,由农民集体和开发商直接进行土地交易,政府只对在土地交易过程中土地收益的增值部分征收税费。
英语语境:
Along with the deepening process of urbanization and increasing demand for urban construction land, the expropriation of rural land by the government has been increasing. However, because of the defects in Chinese land acquisition legal system, the problem of landless peasants caused by the expropriation has become increasingly serious. To change this situation, the government should change its role in acquisition as soon as possible, and the scope of the “public interest” should be defined strictly. Government purchase of rural land should be carried out in nonprofit land areas. While in the profit land areas, the government ought to open up the rural land market, allowing collective farmers and developers to transact with each other directly. The government levies tax only on the value added part of the land profit in this process.
