相较于国外较为成熟的商事留置权制度，我国《物权法》设立的商事留置权仍有诸多问题需要解决：商事留置权主体“企业”的界定，个体工商户、农村承包经营户、农业生产经营者等能否被包含在内；商事留置权客体范围的确定，有价证券能否适用；不受“同一法律关系”限定后，如何对留置财产的范围进行限定，这些问题仍存有争议。这些问题如不能妥善解决，将导致司法实践中无法准确适用商事留置权，削弱商事留置权制度的存在意义，更会使得债权人、债务人、甚至第三人的商业利益受损，对商业交往产生负面影响。

英语语境:

Compared to the more mature commercial lien system abroad, there are a lot of problems about the commercial lien existing in our country's Property Law to be solved. How can we define the "enterprise"——the subject of commercial lien? Whether can the individual business, the lease holding rural household and the agricultural production operator and so on be regarded as the subject? How can we define the object of it and can securities be included? How can we define the property under lien after not being limited to "the same legal relationship"? These questions are still controversial. If not solved properly, these problems will undermine the significance of commercial lien and make its accurate application impossible. And these problems may also damage the interests of creditors, debtors and third parties, which will eventually have a negative impact on commercial exchange.
