尽管法律上“退出自由”从形式上保证了雇员通过退出可以不受契约内不公正对待，但由于“退出自由取决于对生产性资源处置权的私人控制”，而雇员往往又不占有资本这一最重要的生产性资源，所以，雇员并没有实质性的退出自由，此时，国家与法律的适时介入，对于保证雇佣契约的公正性也必不可少。

英语语境:

Although legally “freedom of exit” ensure that the employees can avoid unfair treatment in the contract through the exit in the form, due to the item that freedom of exit depends on private control of disposition of productive resources, the employee often does not share capital which is the most important production resources, so the employee does not have substantive freedom of exit. Therefore, it is also essential for state and law to ensure the fairness of the employment contract through timely intervention.
