权利是利益在法律上的表现，其在运行过程中如果产生了外部不经济，不仅会使权利人的活动水平偏离社会所要求的最优水平，而且由于其内在的经济机制作用，本该由权利人承担的私人成本却转嫁给了社会承担从而导致权利冲突。从外部不经济角度看，权利冲突是权利在运行过程中产生了外部不经济所导致的结果。解决权利冲突必须从经济利益机制上遏制或消除权利运行过程中产生的外部不经济，使这种外部不经济内部化；而法经济学关注法律权利、正义观和经济效益之间的关系，从而能够为权利冲突问题的解决提供新思路。

英语语境:

Right is the reflection of interest in law. If the right brings the external diseconomy during the process of its operation, it will not only make the activity level of the obligee deviate from the optimal level required by the society, but also shift the private cost to society because of the inherent economic mechanism, leading to the conflict of rights. From the perspective of external diseconomy, conflict of rights is outcome of external diseconomy coming from the process of right operation. In order to solve the conflict of rights, we must restrain or eliminate external diseconomy produced during the process of right operation from the mechanism of economic interest, and internalize the external diseconomies. Legal economics concerns about the relationship among legal rights, justice view and economic profit, so it provides a new idea for the solution to the right conflicts.
