《居民身份证法》修改，规定身份证增加指纹信息，其本质是新赋了国家占有公民指纹隐私的权力，是对公民宪法隐私权的限制。这一限制不符合国家限制公民宪法基本权利必须遵循的目的合理原则和比例原则。新法在赋予国家占有公民隐私权力的同时，缺乏对公民指纹隐私的安全保障，使公民指纹隐私安全受到极大的挑战。

The Law of the People's Republic of China on Resident Identity Cards has been amended and the new law sets a new rule that fingerprints should be registered on a resident identity card, the essence of which is giving the nation the power of collecting people's privacy of fingerprints, whereas limiting citizens'constitutional right of privacy. This limitation was not in line with the principle of reasonable purpose and the principle of proportionality that the nation must follow when the nation limited citizens'constitutional civil rights. When the new law gave the nation right to possess the citizen's privacy, it lack of security guarantee of citizens'fingerprints which gives big challenges to the civil privacy.
