根据我国现行刑法第396条之规定，私分罚没财物罪是指司法机关、行政执法机关违反国家规定，将应当上缴国家的数额较大的罚没财物，以单位名义私分给个人的行为。此罪是1997年刑法新增设的罪名，目的是为了预防和打击司法机关和行政执法机关利用其职务便利私分罚没财物的行为。
英语语境:
According to Article 396 of Criminal Law in effect, the crime of secret distribution of confiscated property means that a judicial organ of an administrative law enforcement agency violates the state's provisions and in the name of an organization secretly distributes confiscated property to private individuals that is supposed to hand in to the state and beyond certain amount. This crime was supplemented one in the Criminal Law of 1997.
