一般法院以本诉与反诉出自同一法律关系或同一事实作为牵连关系的依据，但是当被告基于抵消权提起反诉，法院为防止受理错误的发生，顾虑重重，使反诉的受理困难重重，因此通常会以反诉与本诉之间没有牵连关系为由拒绝受理，被告只得通过另行起诉的方式来实现诉权。

英语语境:

Generally, the court judges whether the lawsuit and counterclaim originated from the same legal relationship or the same facts as the basis of involvement, but when the accused set off a counterclaim based on the right of counteract, the court usually refuses to accept dealing with the case on reason that no involvement exists between lawsuit and counterclaim, therefore the accused have to charge a separate suit.
