汉语语境:

违法行为所违背的义务，法学上称为“原义务”或“第一义务”；法律责任则是由于违背原义务所引起的义务，法学上称为“派生义务”或“第二义务”。正因为如此，《法学辞典》第一版把义务解释为一种责任，由于义务、责任都表现为对人们行为的约束，修订版就把义务解释为一种约束。所以，人们在表达经济法律关系内容时，用“责任”来取代“义务”，并无实际意义。

英语语境:

The duty that is violated by illegal acts is called “original act” or “fist duty” in science of law. Legal liability is the duty caused by violation of“original act”, and is called “derivative act” or“second duty”. In the first edition of encyclopedia of law, duty was explained as an obligation. But both duty and obligation is a restriction of people's behavior, in the revised version, the encyclopedia explained it as a restriction. Therefore, in expressing things concerning economic law, it is meaningless for people to replace duty with obligation.
