非典型合同的范围应通过对典型合同的描述加以确定。合同自由原则的确立发展使非典型合同日趋复杂化，非典型合同的法律适用首先应对其进行类型化处理，然而在我国现行法不完备的条件下，欲通过类型化的处理，解决我国非典型合同法律适用的问题极其艰难。应该考虑建立开放性的法律适用体系。

Nonstandard contracts shall be defined by describing standard contracts. Nonstandard contracts are becoming increasingly complex as the development of freedom principles of contracts. The application of nonstandard contract should be started with its classification. However, the current law in China is not complete enough to solve the application problem of nonstandard contract through its classification. An open legal application system shall be build under this circumstance.
