破产宣告后，由破产管理人所实际占有管理的财产集合体构成现有财团Jsemasse，然而现有财团并非分配财团Teilungsmasse，即事实上分配于各破产债权人的财产集合体，乃因现有财团中有作为担保物权标的物者，有自始至终不属于破产人所有者。

英语语境:

After the declaration of bankruptcy, the property managed and in fact owned by bankruptcy administrator constitutes Existing consortium (Jsemasse). It is not equal to distributed property (Teilungsmasse), which is actually a collection of property allocated to creditors for the bankruptcy. In existing consortium, there are subject matter of real rights granted by way of security and subject matter never owned by bankrupt from beginning to end.
