英语语境:

The main symbol of modern legal aid system differentiating from the traditional one is that whether state resumes the legal responsibility for it. The modern legal aid system, which is considered as a system of protecting human rights, has been stipulated in many countries constitutions or constitutional documents. The state responsibility of legal aid has been stipulated in a series of international documents.

职务行为与个人行为的划分直接影响国家赔偿责任的构成。为保护公民起见,应将公民的主观认识与客观标准结合起来,并在特定的情况下以前者为准来界定职务行为。这是因为所谓的客观标准,说到底还是离不开人的主观识别。惟有将二者结合起来，方能找到界定职务行为的恰当标准。

英语语境:

Separation between act of duty and personal act influences the constitution of state liability for compensation. To protect the private party, we should combine subjective cognizance and objective standard, and define the act of duty with the former standard under special circumstance, because objective standard depends on subjective cognizance. Only if combine them can we find appropriate standard to define act of duty.

In the traditional study of constitution, social right, no matter in connotation or extension of right, shares no clear differences with economical right. Social rights have always been academically definite based on obligation of nation and government, limited to the area of legal aid from society. Social rights should be maintained not only based on the duty of nation and government, but also based on protection from family, school and social entity as a whole.
