过境贸易中的知识产权海关保护是国际贸易中知识产权法研究的新问题。虽然WTO有关协定项下的知识产权海关保护义务不包括过境贸易，但是，欧美国家或地区频频对包括我国在内的发展中国家出口过境涉嫌侵权货物采取海关措施或司法补救，并已达成《反假冒贸易协定》，规定过境货物的边境措施。

The customs protection of intellectual property rights in the transit trade is a new research issue of intellectual property law in international trade. Although the customs'duty of intellectual property protection under the WTO Agreement does not include transit trade, the European and American countries and regions have frequently taken customs measures and judicial remedy to the export products on suspicion of infringement from developing countries including China and they have come to an Agreement of Anti-Counterfeit Trade, in which the border measures of the export products are regulated.
