In Administrative Litigation Law, Administrative Reconsideration Law and State Compensation Law, the prescriptions about the scope of family who has heirship are different, which causes the faultage of such three kinds of remedy ways. To fill this gap and protect the private party s rights and interests better, we should adopt the broad-sense concept of maintenance, keep the concepts of maintenance, bringing-up and support consistent, so to broaden the scope of claimant for administrative compensation.
