我国司法实践已采纳所谓的“抗辩权发生主义”，而放弃了“胜诉权消灭主义”，以此来削弱法院的职权主义做法，将诉讼权利切实交给当事 人，且在一定程度上保护债权人，也赋予了债务人以是否主张抗辩权的自主性。

英语语境:

In the justice practice, China has adopted the so-called "theory of right of defense" instead of "the theory of extinction of right of action", with the purpose of weakening the practice of authority principle in courts and actually granting litigation rights to the parties concerned, which to some extent protects the creditor and endows the debtor autonomy to decide whether he choose to propose the right of defense.
