In the legal society, the protection of peasant workers'rights and interests always become a legal problem in the end. In view of legislation, we believe, taking into all factors comprehensively, that peasant workers should be regarded as ordinary labor and be provided legal protection. the characteristics of peasant workers determine the protection to be of two leverls: On the macro level, the Constitution endowd citizens with freedom of migration, which lays foundation and clear the obstacles for the peasant workers to be endowed with the rights as other ordinary labor. The basic labor law stipulates clearly that peasant workers are the subject of protection and endow them the basic labor rights enjoyed by ordinary rural and urban workers.
