工会在进行争议行为时,没有向雇主进行事前告知,这样的争议行为是否违法,其正当性是否被认可,对此学说上一般认为要根据实施争议行为的目的以及对雇主生产经营带来的不当影响和程度进行判断。判例认为,关于争议预告,如果劳动协约上没有规定,企业也没有这种俗成的习惯,仅仅因为没有向雇主事前告知,则该争议行为的正当性是不被丧失的。有的判例进一步认为,不管劳动协约和既成习惯对争议预告如何规定,仅仅因为没有预告,这样的争议行为不能认为其违法[29]。但也有的判例认为,工会负有最迟也要在实施罢工的同时向雇主告知的义务。


英语语境:

Whether the industrial action is illegitimate or whether its legitimacy is identified when the labor union starts industrial action without pre-informing the employer is generally believed to be judged in accordance with the intention of the industrial action and the improper impact and degree on the production and management of the employer. In conformity with the jurisprudence, if there are neither specifications on the labor agreement about the advance notice of the industrial action nor established convention, the legitimacy of the industrial action shall not be deprived just because of the failure to pre-inform the employer. Some jurisprudence further recognizes that no matter what the labor agreement or established convention specified about the industrial action, it shall not be deemed as illegal just because of no advance notice. But some jurisprudence believes that the labor union has the obligation to inform the employer no later than they go on strikes.
