《合同法》第二百八十六条设定的承包人优先受偿权既不是留置权，也不是优先权。笔者认为，应将承包人优先受偿权界定为法定抵押权。因为:第一，承包人优先受偿权与法定抵押权属于同一种权利样态；第二，在我国现行民事担保立法体例框架内，承包人优先受偿权只能为抵押权的一种；第三，考察《合同法》第二百八十六条的立法过程可知，本条自设计、起草、讨论、修改、审议直至正式通过，始终是指法定抵押权。
英语语境:
Contractor s priority of claim in clause 286 of Contract Law of People's Republic of China is neither lien nor priority. The author thinks it should be a legal mortgage. First, contractor's priority of claim and legal mortgage shoule be the same right. Second, according to the present civil security law, it is only a kind of mortgage. Third, we think it is always a legal mortgage after observing its legislative process from its design, drafting, discussion, modification, deliberation to its ratification.
