“迷信犯“是指行为人出于极端迷信、愚昧无知而采取没有任何客观依据、在任何情况下都不可能产生实际危害结果的手段、方法，企图实现犯罪意图的情况。“迷信犯“形成的原因有二:一是行为人基于极端迷信；二是出于极端愚昧无知。有著述以此为标准，将其分为两类:一类是典型的“迷信犯“，另一类是愚昧犯，从本质上看，“迷信“行为也是“愚昧“的表现，将“迷信犯“分为典型“迷信犯“与“愚昧犯“，这种称谓与分类关系不过是服从于传统的刑法理论上的习惯称法，在逻辑上有种概念与属概念关系混淆之误；从实践上看，“迷信“行为与“愚昧“行为也是难以截然分开的。

Superstitious offense refers to the situation where the actor attempts to commit a crime by adopting means and methods, without any fact-based evidence and exerting actual harm in any case, due to his extreme superstition and ignorance. Two reasons contribute to the emergence of superstitious offense, One being over-superstitious and the other over-ignorant. In accordance with it, some books hold there are two kinds of Superstitious offense, namely, typical “superstitious offense”and ignorant offense. However, in essence, this appellation and classification are but subjected to traditional appellation in criminal theory and confuse the species concept with the class concept, since superstition also manifests ignorance. And in practice, the superstitious behaviors are mixed with ignorant behaviors.
