人治在形式上表现为掌权者个人意志之治，实质上则是不受法律制约的绝对权力之治。在人治国家，最高掌权者的个人意志在社会政治生活中具有本原性与至上性，在理念与现实中均先于、高于法律。因最高掌权者的行为不受既定规则的规范，而完全受其个人意志或主观好恶支配，故其行为不具有可预见性。正因为如此，人治政治生活充斥着偶然性与不确定性，广大国民只能终日生活于对国家权力及其执掌者的恐惧之中。

英语语境:

he Rule of Man is the rule of ruler's personal will, essentially the rule of absolute power. The ruler's personal will is the source of political life in the country of Rule of Man and superior to laws. Because the behaviors of ruler are only controlled by his personal will rather than the laws or regulations, they are not unpredictable. Therefore, the political life in the country of Rule of Man is characterized with contingency and uncertainty. People in the country have to live with fear of the power and the ruler.

People begin to recognize law governing due to the emerging of the limitation of laws and the fact that the Communist Party of China has put forward moral governing on the bases of law governing. After all, laws alone cannot carry themselves into practice and the implementation of law cannot come into effect without people. But the legal construction of the modern society can also draw lessons from the beneficial factors of human governing. Constructing a legal society is the inevitable outcome of changing society. But it can’t be said that law governing is superior to human governing. Only if we combine human governing and law governing as well as human and law can the healthy development the society be realized.
