商标和品牌是两个内涵不完全重叠的概念。品牌必须使用而无须注册,品牌一经注册即成为商标;商标只有注册后方可受法律保护并享有商标专用权,仅注册不使用的商标不是品牌,一个企业品牌和商标可以一致,也可以不同,品牌比商标有更宽泛的外延。


英语语境:

Trademark and brand are two concepts that are not totally overlapping in their connotation. A brand is used without need of registration, but will become a trademark once registered. The trademark will be protected and enjoy its exclusive right of use only after registered. Any trademark that is registered but without being used cannot become a brand. A brand for an enterprise may be consistent with its trademark, or may be different. The brand is much broader in terms of denotation than a trademark.
