陈述权和申辩权是行政相对人的重要权利。保障行政相对人的陈述权和申辩权，除行政相对人积极行使权利外，更重要的是行政主体遵从正当程序原则，创设一个相对宽松的制度环境，为行政相对人行使权利提供便利。在行政听证制度日趋成熟的今天，听取陈述和申辩制度的发展却相对滞后，这与国家尊重和保障人权的宪法要求是极不相称的。

The right of statement and right of defense are the important rights for the administrative counterparts. To safeguard the abovementioned two rights, along with the active exercise of right by administrative counterparts, more importantly, subjects of administration should adhere to the principle of due process and make it convenient for the counterparts to exercise their rights. Nowadays, the hearing system of administrative law is becoming increasingly mature while the system of hearing statement and defense is lagging behind, which is incompatible with the requirement of constitution which respects and safeguards the human rights.
