实现诉讼公正与效率的双赢，是我国司法制度改革的主要目的，要达到此目的，必须从审级制度改革这一关键问题入手。我国应改革现行的两审终审的审级制度，将事实审与法律审分开，并将其恒定为第一次上诉审法院和第二次上诉审法院的专属职权，废除审判监督程序，以此构建三审终审制度。
