在信托财产转移制度方面,笔者认为,我国《信托法》未规定信托财产“转移于”受托人,即未明确受托人对信托财产的所有权,这样的制度设计并不能实现立法者试图通过不赋予受益人所有权而达到保护受益人利益的目的,并且,这样的制度设计也不利于受托人行使管理职能、不利于信托目的的实现。

英语语境:

In terms of the trust property transfer, the trust law of our country does not stipulate the ownership transfer to the trustees, meaning it does not specify the ownership of the trustees. This system design cannot achieve the aim of the lawmakers to protect the trustees by not granting them ownership. And it is also disadvantageous for exercising the trustee’s duty of managing the trust property and realizing the purpose of trust.
