涉外同居关系，是各国普遍存在的社会现象。外国或外法域的实体法或司法判例非常正视这一客观存在，并通过立法或司法判例有限制地保护该特殊身分关系。我国大陆婚姻家庭立法却回避这一现实问题。实际上，涉外同居关系并未违背强制性或禁止性法律规范及公共秩序保留原则，而且正视它的存在具有重要的法价值。
英语语境:
Foreign-related cohabitation exists at large in all countries. This is taken into account in foreign substantive law or judicial cases, and this special relationship been limitedly protected with legislation and judicial cases. Whereas in mainland China, it is avoided in the ligislation of marriage and family. Actually, foreign-related cohabitation don't break the compulsory or prohibitive regulations and the reservation of public order, and it is of important value to the law to confront its existence.
