There are obvious defects in the existing constitutional supervision system in China. The lack of a special institution for constitutional supervision presents as a serious problems in the check of unconstitutionality. At present, there are three kinds of constitutional supervision models in the world, namely, supervision from the parliament or the power organ, supervision from common court and supervision from a special institution. Based on China's current situations, we should learn from the advanced legislation model and experience of other countries.
