As of how to define the form of liability for the breach of contract, there is no satisfying answers readily offered either in the current contract laws of our country nor academic researches, but it is a very important consideration in legislation and judicial practice. When we determine the form of liability for breach of contract, besides current laws and understandings, we also have to abide by the principles of voluntariness, preference for contract parties agreement over lawful regulations. Also, the penal clause pertaining to damages should be included into the consideration to improve the system of liability for breach of contract.
