未成年人犯罪作为一种特殊的犯罪类型，具有显著不同于成年人犯罪的特点。对未成年人犯罪的刑事处罚必须充分考虑到这一事实特征。否则，不仅设定处罚措施的科学性将严重受损，而且实践中还会造成高负面效应。现行刑法典的罪刑设计是以成年人犯罪为基调和标准的，未能考虑到未成年人犯罪的特殊性，因而在处罚制度的设计上存在着严重的制度性缺陷。
英语语境:
As a special type of crime, juvenile crime has obvious character different from adult crime. The criminal punishment to juveniles crime must fully consider this character. Or else, not only the science character of punishment method will be damaged seriously, but also bad influence will be produced in the practice process. In the present criminal code, the punishment system is designed according to the criteria and standard of adult crime, which dose not consider the speciality of juvenile crime, and, as a result, the design of the punishment system has serious defaults.
