现代合同立法以对价及有偿为原则，无偿合同仅作为庞大合同体系下的例外和特殊情形存在，其在成立要件、终止方式、承担责任的标准等方面，都与有偿合同的制度设计有别。但无论社会发展如何商业化，利益与效率如何为社会一般交往所强调。无偿合同却未因其与商业社会之“主流价值观”不符而式微；相反，自始发挥着多元化的社会功能，在一定程度上促进了财产交易，提升了社会团结。又鉴于合同损害赔偿责任作为民事责任体系的重要组成部分，关系到交易双方的意思自由及合法权益保护两种价值的平衡而关注。

英语语境:

Modern contract legislation is based on the principal of consideration and compensation, and gratuitous contract only exists as an exception and special condition in the huge contract system, which differentiates from onerous contract's system design in way of establishment requirement, termination method, the standard of obligation undertaking and so on. But no matter how commercialized of social development, interest and efficiency are dominant in general social communication. Gratuitous contract does not get weak despite of its discrepancy with commercial society's "mainstream values", on the contrary, its diversified social functions always promote property transactions in a degree and social solidarity as well. In light of the fact that as a main part of civil liability system, the damage compensation liability of contract is related to the balance between two parties'autonomous willingness and legal rights'protection.
