英国于2007年4月2日施行的《意思能力法》不仅提出了对意思能力欠缺之人保护的五项基本原则，以及意思能力的判断标准；而且重点规定了新的持续性代理权制度，将持续性代理权制度适用范围从财产扩大到人身；同时设立了监护监督制度和预先保护容易受伤本人之三项关键制度，即独立意思能力拥护机构、拒绝治疗之事先决定、增设刑事罚；还专门设置了保护法院和公设监护人。

The Mental Capacity Act, implemented on Apr 2, 2007 in Britain, not only provides a set of five key principles to protect persons who lack mental capacity, and the criterion of capacity, but also makes new provisions about Lasting Powers of Attorney whose scope of application is extended from property to personal care. The Act also establishes supervision system of guardianship and three further key provisions to protect the vulnerable, including Independent Mental Capacity Advocate Service, Advance Decisions to Refuse Treatment and Supplementary Criminal Penalties, and such two new public bodies as the Court of Protection and the Public Guardian are especially created.
