What status do the legal struggles possess in the democratic revolutionary movement in modern China? The 1916 Republic-Defending War has given a definite answer. The organizers of the war paid much attention to the legal struggles in their armed struggle agianst the the Northern Warlords led by Yuan Shikai. They used the spirit and principles of international law, law of war, constitutional law and criminal law to disclose Yuan Shikai's criminal activities of destroying democracy and legal system in order to demonstrate the legality of their fight against Yuan Shi-kai and find legal foundations.
