居住权作为一种古老的制度，起源于罗马法，属于人役权的一种形式。为了实现“居者有其屋”的目标，主要国家的立法都不同程度地继承了罗马法的居住权制度，并对其作了一些改进。法国民法比较完整地继承了罗马法上的居住权制度，其规定的居住权主要以契约方式设立。德国法设立了几种不同形式的居住权：一是民法典中的传统居住权；二是《住宅所有权法》上的长期居住权。

As an ancient system, right of resident came from Roman Law and is a form of personal servitude. In order to achieve the aim of residents owning their own homes, the civil law of the major countries all over the world accepted dwelling right system of Roman Law in different degree, and made some improvement. French Civil Law accepted the dwelling right system of Roman Law completely, the dwelling right of which is established mainly by contract. The dwelling right that is set by German Civil Law has two forms, one is the traditional dwelling right in Civil Code, and the other is the right of long-term resident in Right of Housing Ownership Act.
