强制执行法作为一个法律体系，是由许多制度构成的，它们是宏观的理论的支撑和辅佐。目前的理论对强制执行宏观论述已取得一定的成果，但对具体制度的构建却较少。笔者针对我国目前司法执行过程中存在的问题，根据执行理论，并借鉴国外和地区的有益经验，对于执行主体的设置，执行管辖，执行启动时申请执行的期限、执行通知书，执行进行中被执行人财产的调查、强制措施、执行援助，执行终结，执行救济和执行威慑机制等若干亟待修改和完善的执行法律制度进行探讨。

As a statutory framework, enforcement of judgment is concerned with many rules and principles that underlie and enrich the macro-theory. Though current theoretical research has yielded certain results, few are related to the specific structure of the regime. This paper analyzes the problems of enforcement of judgment in current China's judicial enforcement. In accordance with relevant theories and by drawing foreign experiences, it also tackles the problems concerning the setting of the enforcer, enforcement jurisdiction, the time limit of request for execution in initiating the execution, notice of execution, investigation of the property of the enforced in the execution, enforcement measures, enforcement assistance, enforcement termination, enforcement relief, enforcement deterrence mechanism and other legal systems of enforcement which urgently need modifying and improving.
