随着知识经济时代的到来和知识产权学科的不断发展，驰名商标已日益为人们所关注，人们对驰名商标的保护意识也不断增强。然而，对驰名商标的特殊保护往往会助长商标权所有人对其所拥有的权利的滥用，而且我国目前在驰名商标认定制度方面存在的缺陷也导致了驰名商标保护中的权利滥用行为比较普遍。这些行为主要表现为:蓄意制造商标侵权的恶意诉讼行为；限制他人的合理使用权的行为；利用后驰名的商标对抗在先注册的商标的行为；将驰名商标滥用于商业广告的行为。

With the advent of Knowledge Economy Age and the development of intellectual property disciplinary, public's attention to and the protection awareness (fortress mentality) of well-known marks have been increasingly raised. However, the special protection of well-known marks would often encourage/foster the abuse of the rights owned by the mark owners. Besides, the deficits in well-known mark accreditation system have led to the abuse of rights in the process of well-known mark protection as well, which are mainly presented with intentionally instituting lawsuits against manufacture mark infringement, limiting others'reasonable rights of mark use, making use of the later well-known marks to confront the former registered mark and abusing well-known marks in commercial advertisements.
