集体建设用地使用权不能简称为集体土地使用权,权利主体包括农民个人、土地所属集体社区以外的组织,权利客体为乡村非农建设用地;权利人对于建设用地可以占有、使用、收益,其中的使用权应包含权利转让权、权利投资权和抵押设定权,作为用益权,权利人就享有物上请求权;其终止原因有土地灭失、放弃、权利人死亡、期限届满、国家征用等。法律不应当严格禁止集体建设用地使用权进入市场流转。
