用替代性纠纷解决机制处理劳动争议是社会发展的必然趋势,也是国际社会处理劳动争议的先进经验,但因为我国劳资双方力量的严重失衡,致使我国劳动调解和劳动仲裁这两种替代性纠纷解决机制发生病态的变化,以致我国现行劳动争议处理机制弊端重重。为此,我国的劳动者必须通过自主组建工会壮大自已的力量。只有劳资双方力量相对平衡,才能让替代性纠纷解决机制发挥应有的功能。
英语语境:
Due to the current social development, the general trend of labor dispute resolution is alternative dispute resolution mechanism, which is also been widely adopted in the international community. However, the growing imbalance between employee and employer in China leads to the distortion of two alternative dispute resolution mechanisms, i.e. labor mediation and labor arbitration. Hence there exists serious drawbacks of China's current labor dispute resolution mechanism. In view of this, employees should have their voices heard by organizing trade unions. The alternative dispute resolution mechanism will not function well unless the balance between the employee and employer is achieved.
