各国在承认和执行外国法院判决时，通常要求该外国与本国之间存在互惠关系。但随着国际间交往的发展，越来越多的国家开始放弃互惠原则，或者对互惠原则进行软化处理。我国立法中仍然有必要继续保留互惠原则，实践中采用推定存在互惠的做法，以便于我国和外国之间的互利合作。

英语语境:

In many countries, the principle of reciprocity is a general precondition for the recognition and enforcement of a legally effective judgment made by a foreign court. However, with the development of international transactions, more and more countries begin to abandon or weaken this principle. In Chinese law, this principle needs to be upheld. In practice, the reciprocity is presumed so as to facilitate the mutually beneficial cooperation between China and foreign countries.
