家长主义思想在西方社会的流变经历了一个从伦理到法律的过程。希腊伦理家长主义思想虽然已经不适合当代社会，但其为我们认识当代西方法律家长主义思想提供了一个最初的视角；近代的古典自由主义也存在软家长主义思想，并且还对其进行了实证性的研究；现代的硬家长主义思想丰富了法律家长主义体系的具体框架，且已经颠覆了伦理性这一特征，使得过渡到当代法律家长主义理论。因此，当代法律家长主义思想与中国传统的家长主义理念存在根本的区别。

英语语境:

The paternalism in the western countries has experienced an evolution from the ethical to the legal. Although Greek ethical paternalism is no longer suitable for contemporary society, it provides an initial perspective for us to understand the contemporary western legal paternalism; and the classical liberalism still has the idea of the soft paternalism which isresearched empirically; then the modern hard paternalism enriched the framework and system of legal paternalism, overturned the characteristic of ethic, and made the transition to the contemporary theory of legal paternalism. Therefore, the legal paternalism was fundamentally different from the Chinese traditional paternalism.
